    investigate on your behalf This form also incorporates our terms and conditions which outline the no win no fee agreement between us What is the complaint questionnaire This is the document which contains all of the information you gave us during the initial call It is the evidence to support your claim so it s important to make sure all the details are correct If anything is incorrect please cross it out and write in the correct information Once you re sure everything is correct please sign Section F ready to return to us in the reply paid envelope provided Why do you need a form of authority The green document is a form of authority which is your permission for us to contact the bank on your behalf It also contains our Terms Conditions A separate form is required for each claim you make and the correct account number must be included or the bank will not investigate Information on how to obtain a missing account number is listed on the reverse of the form Once you have all the information please sign both sections of the form and add it to the questionnaire to be returned to us What happens if it s a joint claim If it s a joint claim it s important that both partners sign all the documentation or the claim cannot proceed Both parties must give their permission before the bank will undertake an investigation What is the Schedule of Claims This is a document which lists all the claims you have with us Please fill in any missing account numbers and complete the requested information in the panel which will help us when we need to contact you with updates on your claim This goes along with all the other documents to be sent back to Gladstone Brookes IF YOU HAVE ANY OTHER CASES NOT LISTED PLEASE COMPLETE THE DETAILS ON THE FORM Why do you need me to supply documentary evidence This documentary evidence is not essential and the bank will still investigate if you don t send any However any evidence that you might have which shows PPI was attached to the account like the original credit agreement or a statement showing PPI payments proves to the bank that PPI was added to your agreement NB Please send copies of all documents to ensure originals don t get lost in the post Why have you sent duplicate forms Duplicate forms are required if you have multiple claims as each claim needs to be handled separately because the bank wants details of the actual sale so we have to complete documents for every policy that you hold Which documents do I sign and which do I keep All the documents need to be signed and returned to Gladstone Brookes in the reply paid envelope Can you get account numbers for me We can try to assist you but the best way is for you to check any documents you hold loan

entitled to the information under the Data Protection Act so be persistent and ensure the bank understand this They may also ask you to complain direct to them which you are entitled to do but remember we are here to provide an impartial service to you and remain happy to act on your behalf Click here for a list of Bank Contact Numbers Q What happens when you make the claim Once we are in receipt of all the information it is important that we review your complaint before we draft a formal letter of complaint LOC to them This LOC is the first notification the bank have that a complaint is being made against them so it s important that we get it right You will be notified when this is done Q The bank can t trace my account but I gave you the details at the start It is the PPI policy attached to the account that they cannot trace not the loan or credit account number Q Can you get account numbers for me We can try to assist you but the best way is for you to check any documents you hold bank accounts statements on line banking etc or simply call the bank and ask them for the number Click here for a list of Bank Contact Numbers Getting the Decision Q How long will my case take The banks have an 8 16 week deadline in which to give a final decision after they have acknowledged receipt of the claim Most cases are settled within that timescale but some do take longer The most common cause of the delay is the bank requesting further information from you in order to make their decision This is why it s important to supply the requested information as quickly as possible We have to request the information from you because the bank will not supply it direct to us despite you having signed a form of authority Q What happens if the bank doesn t answer within 8 16 weeks Sometimes the bank takes longer to investigate a particular case It s Gladstone Brookes job to keep them under pressure to deliver the final decision as soon as possible by pro actively chasing them The bank can be forced to give their response by referring the case to the Financial Ombudsman Service FOS which will cost the bank 850 but this is a lengthy process so pressure is applied to the bank first Q What happens if my case is upheld If the bank uphold your claim against them they will then calculate how much compensation is due to you This will be the return of all the premiums you have paid on your mis sold PPI policy plus whatever interest that money would have earned Gladstone Brookes also tries to obtain an additional 8 compensation but not all banks pay this You will be notified of the amount in a letter from the bank which will also show you the calculations they have used to arrive at their total Gladstone Brookes will receive a copy of this letter which will enable us to check that the offer is a fair and equitable one Once the offer letter is received the file is passed to our Gamma team to perform these checks and make sure the money is paid to you as soon as possible Q What happens if my case is rejected The reasons for a rejection must be given in writing Gladstone Brookes will analyse the rejection and advise you whether or not there are grounds to make an appeal Q Can all rejections be appealed Some rejections cannot be appealed for example if the agreement was signed before the bank became regulated by the Financial Conduct Authority FCA or if it was a non advised sale where no advice was given to persuade you to take it out In such cases we would close your file and there would be no fees payable because we were unable to obtain any compensation for you Q What happens if an appeal can be made If we can find sufficient evidence to appeal the decision we will do so on your behalf first to the bank and then later if necessary to the Financial Ombudsman Service FOS The reason for going back to the bank first is that we have the chance to overturn the rejection in just a few weeks If the bank refuses the appeal we still have the opportunity to take the case to FOS to try to get the rejection overturned Unfortunately FOS are operating under a huge backlog of more than 400 000 cases and a decision from them could take from 12 to 18 months If a case is appealed the file is moved on to the specialists in our Beta team Q Why have the bank upheld extra cases The rules under which claims are investigated changed after the British Bankers Association lost the Judicial Review into the way PPI complaints are investigated One of the new rules is that the banks now have to investigate all agreements linked to one about which a complaint has been made to see if PPI has been mis sold on them too Gladstone Brookes frames its letters of complaint to ensure that the bank complies with this new ruling in order to reclaim the full amount you are entitled to This often results in the bank paying compensation on a series of top up loans resulting in our clients receiving much more money than they expected Q This is a
