  • Worker badly burned after firm ignores safety risks | Alcumus SM&MS
    burned in a flashover during hot cutting work at the Fox s Biscuits factory in Batley The 61 year old Ossett man was one of a team working for steel fabricators Hartwell Manufacturing Ltd which had been hired to remove three disused oil tanks at the Fox s site in Wellington Street in February 2012 The worker was using an angle grinder to cut a hole in one of the tanks which had only recently been drained of fuel when sparks ignited flammable vapours causing flames to erupt In a panic the worker inserted a high pressure water lance into a pipe opening to try to put out the fire but instead caused a blow back of flames to be ejected from the opening engulfing his lower body in flames Huddersfield Magistrates heard 12 Aug that another worker at the scene rushed to the injured man s aid putting out his burning clothes with a fire extinguisher He suffered extensive burns and needed prolonged treatment and rehabilitation The Health and Safety Executive HSE investigated and prosecuted Hartwell Manufacturing Ltd for safety breaches after discovering the firm had deviated from a safe system of work it had earlier agreed with Fox s Biscuits and their site managing firm Instead of using cold cutting equipment the company had used a high speed angle grinder which produces heat and sparks HSE also found that the whole job of removing the huge tanks in particular the means of access into the oil tanks and working in a confined space had not been properly planned by Hartwells In addition its emergency arrangements to evacuate any casualties on site were fundamentally flawed The court was told the company s managing director had failed to liaise with Fox s Biscuits when problems with access to the tanks

  • Asbestos Firm Guilty of Exposing Workers | Alcumus SM&MS
    demolishing the school owned by Lincolnshire County Council the site was being demolished after the school buildings were replaced by a new school an asbestos survey was carried out before work began to identify the areas in the building containing asbestos and recommending how this was to be treated to ensure safe removal according to the survey the end walls of the school s main hall were covered in a spray applied coating of asbestos and should therefore be removed by a licensed contractor under safe controlled conditions these recommendations were ignored by Angus Group Ltd and the asbestos spray coating was chiseled off using power tools without any screens enclosures or air extraction systems in place and asbestos containing material was bagged and carried to a skip outside Angus Group Ltd notified the main contractors that the asbestos removal work on the main hall was finished but when the project agents and main contractors visited the next day they found the hall covered in dust and patches of asbestos material still on the wall The court was also told that HSE found a catalogue of failings in the way the work had been planned and carried out The exact location of asbestos material wasn t identified and the work only took one day to complete rather than the planned seven In addition risk assessments were too generic enclosures segregation and containment measures were inadequate plans lacked detail access and transit routes through the buildings weren t clear employees lacked specific instruction and there was no reference to the original asbestos survey in the plan HSE experts concluded the company s safeguards to control the asbestos risks were seriously inadequate leading to an unnecessary release and spread of dangerous asbestos fibres and dust The plan and risk assessment for the

  • Surrey Firm in Court After Asbestos Found at Girls’ School | Alcumus SM&MS
    light on 21 July 2011 and today 13 January prosecuted the company for safety breaches Guildford Crown Court was told that Buxton Building Contractors Ltd was the principal contractor for a scheme to remodel the school s dining area and kitchen The firm had asked a surveyor to look specifically at the undercroft area as it had been omitted from an earlier asbestos report HSE s investigation found the survey had highlighted the presence of the hazardous material however Buxton Building Contractors had failed to act either to deal with it or to provide any safeguards on site It had allowed unrestricted access by a variety of other workers including a 19 year old apprentice electrician who had been working in the undercroft for at least two weeks After the worker discovered the presence of the asbestos insulation board the area was sealed off by a licensed asbestos contractor Buxton Building Contractors Ltd of High Street Caterham Surrey was fined 50 000 and ordered to pay 26 217 after admitting a breach of Section 3 1 of the Health and Safety at Work etc Act 1974 by failing to plan manage and properly monitor the construction work at the school After the hearing HSE Inspector Melvyn Stancliffe said This was a serious failing on the part of the company Having correctly commissioned an asbestos survey it looks as though no one at Buxton Contractors Ltd bothered to read it Or if they did they disregarded its contents and failed to act to protect site workers from exposure to what is one of the deadly killers in the construction industry As a result several people including the young apprentice were unnecessarily exposed to the risk of inhaling asbestos fibres One can only wish and hope that there are no serious consequences
