    breach Fire Safety Legislation This follows the prosecution of a landlord and an individual operating a property letting business in Harrogate They were ordered to pay 13 618 16 in fines and costs Following a serious fire in a basement flat at 29 Nydd Vale Terrace Harrogate on 30 th December 2012 an inspection of the premises was conducted by fire safety officers from North Yorkshire Fire and Rescue Service and Environmental Health Officers from Harrogate Borough Council During the post fire inspection deficiencies in the required fire protection measures were found Including Lack of a fire alarm and detection system Lack of self closing fire doors No assessment of the fire risk had been carried out by those responsible Officers from North Yorkshire Fire and Rescue Service worked closely with Harrogate Borough Council during the investigation of this fire incident Due to the seriousness of the fire protection deficiencies and the associated risk of death or serious injury which was present North Yorkshire Fire and Rescue Authority took the decision to prosecute Rava Properties Limited the company operating the rental property Mr Nigel Rudd former director of Rava Properties Limited was also prosecuted On July 2 nd 2014 at Harrogate Magistrates Court Rava Properties Limited pleaded guilty in total to two contraventions of the Regulatory Reform Fire Safety Order 2005 Also on July 2nd 2014 at Harrogate Magistrates Court solicitor Mr Rob Rode entered a plea of guilty on behalf of Mr Nigel Rudd in his absence to two contraventions of the Regulatory Reform Fire Safety Order 2005 In sentencing Magistrates stated that These were two serious offences Firstly in not having conducted a fire risk assessment breach of article 9 And secondly in failing to provide adequate general fire precautions breach of article 8 There was a vulnerable

  • Housing firm in court over Blackpool balcony collapse | Alcumus SM&MS
    29 May 2012 when he felt the balcony move beneath his feet as he turned the key in his front door He dived into his flat and looked back to see that the walkway had gone Blackpool Coastal Housing Ltd was today 1 August prosecuted by the Health and Safety Executive HSE after an investigation found that the company had known the walkways were dangerous for several years but had failed to act to make them safe Preston Crown Court heard that Blackpool Coastal Housing had taken over responsibility for the flats from Blackpool Borough Council in January 2007 The council had previously arranged for a structural engineer to carry out a survey of the walkways after a worker noticed some of the fixings for the handrails had pulled away from the wall Further tests were arranged which identified structural problems with the balconies at Newby Place and two neighbouring blocks of flats and alerted the council to the need for major repairs However Blackpool Coastal Housing failed to carry out any repairs despite many of the senior staff who knew about the structural issues transferring to the new organisation along with relevant files when it was set up in 2007 The court was told that the company eventually appointed a structural engineering consultant to design a temporary propping solution for the balconies in September 2008 However his recommendations were also not implemented Instead in March 2009 temporary scaffolding was erected under some of the balconies on the opposite side to Mr Bleasedale s flat although it is unlikely this would have been capable of supporting them if they fell Blackpool Coastal Housing eventually started work to replace these balconies in May 2012 During the project the site manager reported his concerns that all the balconies at Newby Place may

  • Suspended prison sentence after faulty gas service leaves tenant unconscious | Alcumus SM&MS
    18 08 2014 by Hannah Archer A Suffolk gas engineer has been handed an 18 week suspended prison sentence after carbon monoxide fumes from an incorrectly serviced gas fired heater left a tenant unconscious Greg Ranson 27 a Gas Safe registered engineer from Ipswich was prosecuted by the Health Safety Executive HSE following safety failings which led to the leak of the poisonous gas Ipswich Magistrates Court heard today 12 Aug that Mr Ranson had been hired to service a gas fired warm air heater at a ground floor flat in Sproughton in April 2013 before William Tumilty 59 moved in in May As the weather was mild the heating system was not turned on until November 2013 However once the heater was operating Mr Tumilty immediately fell ill and did so again when the heating was used the next day On the third day the heating came on automatically at 4 00pm and at about 7 00pm Mr Tumilty collapsed unconscious in the hallway He regained consciousness at 7 45 am the next day Hospital tests confirmed he had been poisoned by carbon monoxide The occupants of a maisonette directly above the flat a young couple with a two year old child were also affected by the potentially lethal fumes and required hospital treatment HSE s investigation established that the source of the carbon monoxide was the gas fired heater Examination revealed the heat exchanger assembly had been blocked by a fine dust which was preventing the harmful by products of combustion escaping safely up the flue The heat exchanger should have been inspected and cleaned during the service undertaken by Mr Ranson but did not appear to have been cleaned for several years Greg Ranson trading as Ranson Plumbing and Heating Ltd of Downing Close Ipswich was given
