    case back to Judge Branston and slapped residents with a 24 000 costs order which they maintain they cannot afford to pay Delivering his revised judgement at Chelmsford Magistrates Court on Tuesday February 2 Judge Branston said Mr Justice Garnham had ordered him to accord the council appropriate respect for its reasoning and conclusions as Parliament s delegate The judgement read It seems to me that I am bound by Mr Justice Garnham s judgement to conclude that on the evidence presented to this court I cannot be satisfied that the borough council was wrong to make the decision that it did He told the court I do not consider that the borough council s decision is the right decision today It is a decision made by a council officer and one elected councillor It is a decision rejected by a vote of the full council In particular it is a decision which is rejected by more than 400 residents of the areas who will actually be affected and who actively opposed the decision by bringing this appeal at court It is a decision which on the evidence presented to me is not today demonstrably supported by any residents One might have thought that in a democracy the democratically elected borough council would now have some regard to the wishes and feelings of its constituency Basildon Council attempted to recover a further 2 150 from residents but Judge Branston refused the request saying I consider that the residents have now been made to pay large costs already I do not find that it s just and reasonable to require them to pay more Somercotes resident John James one of three people who brought the legal challenge on behalf of 422 residents praised Judge Branston saying He has been a fair man Tory council leader Phil Turner criticised Judge Branston s comments about the proposed changes but said he felt the council had failed by failing to mediate before the issue resulted in court action He said It sounds so much like sour grapes Legally there was nothing wrong with what we we have done but he doesn t agree with it so ya boo sucks To say we don t have residents in our heart I m pretty insulted by that That s the only thing we are looking at when we do these sort of things We thought it was the right thing to do for health and safety I m not going to gloat I m pleased that we have got to the bottom of it I m sorry to hear that it s ended in bitterness the bitterness of the judge as well by the sounds of it But nobody really comes out of this winning When I m against my residents and when they are losing I think we all lose The last thing you want in any situation is ending up in the law courts That seems like just a failure all round UKIP ward
