  • EXCLUSIVE: Residents landed with £40k legal bill they 'cannot pay' as High Court judge reverses judgement in battle with Basildon Council | Yellow Advertiser
    shocked by the costs judgements and took no joy in the result He said I have a great deal of sympathy with the residents and a bill like that to anyone is going to come as quite a hefty shock Mr James responded Mr Turner because he s so distressed by our situation maybe he can come and visit me in jail UKIP ward councillor Frank Ferguson has previously offered to pay any costs the residents cannot afford but could not be reached this afternoon to comment on how he would pay the bill Residents took the council to Basildon Magistrates Court in April where District Judge Gareth Branston heard almost 80 per cent of residents had objected to the proposed name changes The council wants to change road names and door numbers as part of an estate wide regeneration project which began almost a decade ago However one witness testified at the April court hearing that they had experienced complications as a result of their own address change early in the scheme for the next eight years The council claimed the address changes would help emergency services navigate the estate but one witness testified that as a result of his address change an ambulance had been unable to locate him during a medical emergency District Judge Branston ruled the council s decision was unreasonable and said merely putting up better road signs for the existing addresses would do the job In his judgement today Mr Justice Garnham described District Judge Branston s decision as an impressive piece of work which he said was careful and thoughtful However he ruled District Judge Branston had placed the burden of proof on Basildon Council to justify the scheme rather than placing the burden on residents to prove it was wrong He said The district judge was right to say that the council s opinion on the issue was a matter to which careful attention was required and he was right to say the burden of proof was on the residents But in my view he fell into error when he applied those principles to the facts before him In my opinion when he came to consider the facts he appears to have paid little attention to the council s opinion and he appears to have regarded the burden of proof as falling on the council Furthermore the district judge failed to clearly identify where he said the council had gone wrong He proceeded on the basis that he was not satisfied that the council s judgement was right whereas it was only if the council s decision was shown to be wrong that he could go on to substitute his opinion for theirs No date was set for the next hearing with District Judge Branston Share this story Other Stories by Charles Thomson Man dead and teen girl in life threatening condition after Barking accident A13 partially closed and causing severe delays A YOUNG man has been killed in an accident on

    flawed as it placed the burden on the council to overcome residents objections whereas residents are supposed to have the burden of proving the council s decision is wrong Joking about the estate s former nickname Alcatraz Mr Gasztowicz said District Judge Branston was literally giving the lunatics control of the asylum He said He has given overwhelming weight to the views and wishes of residents which have no objective basis Mr Gasztowicz argued that District Judge Branston had gone beyond his remit and interfered with the council s administrative rights appropriating to himself the decision of how taxpayers money should be used He continued What he does is to change the test and say that the views of the residents must prevail unless they are outweighed It amounts to saying that because Parliament has given a right of appeal to aggrieved people it means that their wishes themselves have to be considered an important objective The reason why the council wants to change a name is a matter for the council They don t have to give a sufficient reason The statute doesn t require them to give any reason at all Barrister Caroline Moonam representing the residents accused Basildon Council of nitpicking over minor aspects of the judgement which she said did not unduly affect the final decision She said My submission is that the district judge was entitled to make the decision he did It is suggested that the views of the residents have been raised to an overwhelming situation and in my submission they have not He has considered everything in the round Mrs Moonam said District Judge Branston had considered all of Basildon Council s arguments in favour of the change and concluded in each case that they did not hold up The council claimed emergency services would find the estate easier to navigate with the new street names and door numbers but a resident testified at the Basildon Magistrates Court hearing that after his address was changed in an earlier phase of the Five Links regeneration an ambulance had been unable to locate him in an emergency situation Mrs Moonam said the Basildon Magistrates Court had heard evidence from one resident who suffered inconveniences for eight years as a result of their address change She said the council had also failed to present evidence of how the address changes would counter the estate s poor reputation She said Change for change s sake in my submission is wrong There must be a reason for them to do so So the district judge is considering on the appeal what is reasonable She claimed case law demonstrated that District Judge Branston was entitled to base his judgement on evidence gathered and presented after the decision was taken as well as whether the decision was technically lawful at the time it was taken Mr Justice Granham told both sides I m going to reserve my judgement on this I would hope to be able to hand it

    Hendrie and Leonard forced Leutwiler into a couple of smart blocks After going in at the break and arguably deserving to be three up and with just Atkinson s strike to show for their efforts the Blues were caught cold two minutes into the second period when they failed to clear Whalley s free kick and Mangan levelled from close range Having seen Noel Hunt hobble off only four minutes after the break his replacement Timlin only lasted 16 minutes after collecting two yellow cards Boss Phil Brown was then forced into a reshuffle with loanee Jamar Loza replacing the now sole striker Mooney and Sam McQueen on for the tiring Payne Southend then had to endure another Shrewsbury barrage with Bentley twice denying Akpro But as in the opening period Southend were back in front when Hendrie ghosted into the six yard box and guided home Loza s chipped pass to send the 231 travelling support wild By now a desperate Shrewsbury tried to get back in the game and last ditch Southend defending saw all ten men behind the ball with skipper Adam Barrett commanding at the back But with five minutes stoppage time to endure Southend had Adam Thompson to thank for denying Akpro a certain equalizer A delighted Brown said We had to dig the win out tonight It was never pretty and wasn t helped by Michael Timlin s sending off but the referee has booked Michael on the say so of the fourth official with the lad clutching his head Then Michael had gone in foolishly for the second yellow card But again we showed tremendous character That s the second game on the bounce where we have gone down to ten men and have come out winners That to me is a sign of spirit in the changing room After the sending off we changed tactics defending from the halfway line But when you re down to ten men and bringing on fresh legs and men who don t know the game in Jamar Loza and Sam McQueen they didn t half work hard We firmly believed fatigue would play a part The loan lads played their part but even without Tyrone Barnett up front we still started with three strikers But we lost Noel Hunt soon after the break with a back spasm and it was a quick early goal after the break that took the wind out of our sails a wee bit Brown concluded I think we have turned a corner The nil nil draw at Peterborough with Dan Bentley s penalty save was a key factor But I ve always thought this was going to be a big week After the FA Cup weekend we seem to be catching teams at the right time Timing is important if you want success The punters are now looking forward to Colchester on Saturday and it will be a great game for sure Matchwinner Hendrie added It was really tough out there
